Welcome to Nishulk4U. These Terms and Conditions ("Terms") govern your access to and use of the Nishulk4U website, mobile application, APIs, and associated services (collectively, the "Platform"). By registering, accessing, or using the Platform, you ("User", "Candidate", or "Employer") agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Definitions

• "Platform" refers to the Nishulk4U website and all related domain infrastructure.
• "User / Candidate" refers to individuals utilizing the platform to seek employment, compute salaries, or build resumes.
• "Employer / Recruiter" refers to automated or verified corporate entities posting job vacancies and browsing candidate profiles.
• "Content" encompasses all text, graphics, logos, job descriptions, resume data, and functional tools provided on the platform.

2. User Eligibility and Registration

To use our Platform, you must be at least 18 years of age and capable of forming a binding contract under applicable law. When creating an account, you agree to provide accurate, complete, and up-to-date information. Creating fake profiles, impersonating others, or providing false academic and professional credentials will result in immediate termination of the account and a permanent network ban.

You are solely responsible for maintaining the confidentiality of your account credentials. Any activity occurring under your account is your structural responsibility.

3. Core Services and Limitations

For Candidates: Nishulk4U offers free access to a broad database of job postings and career utilities. We do not guarantee interview calls, job offers, or successful employment. Nishulk4U acts merely as a bridge and is not an employment agency. We hold no liability over the hiring process or decisions made by the Employers.

For Employers: By subscribing to our SaaS models or utilizing free tiers, employers acknowledge that they must abide by strict anti-discrimination and equal opportunity laws. Job postings must be authentic, currently available, and accurately described. Multi-level marketing (MLM), pyramid schemes, and unpaid internships masquerading as full-time employment are strictly prohibited and will be removed without refund.

4. Prohibited Activities

While using Nishulk4U, you explicitly agree NOT to engage in the following activities:

• Scraping, crawling, or extracting data from the platform using automated bots or scripts without express documented permission.
• Uploading malwares, trojans, or executing SQL injection attacks against our infrastructure.
• Posting highly sensitive information, defamatory statements, or content violating intellectual property rights.
• Employers charging candidates an "application fee" or "security deposit". Any employer found doing this will be immediately suspended.

5. Fees and Subscriptions (Employers)

While the core platform remains free for candidates, certain recruiter functionalities, including API bulk-posting and CV-database access, are offered as premium subscription services. Fees are payable in advance and are non-refundable except as mandated by consumer protection laws. Continuous failure to settle invoices may result in the downgrading or suspension of employer accounts.

6. Intellectual Property Rights

All platform infrastructure, underlying source code, algorithms, visual design, and proprietary calculators are the exclusive intellectual property of Nishulk4U. Users are granted a limited, non-exclusive, non-transferable license to access the Platform for its intended use. You may not replicate, reverse-engineer, or commercially exploit our codebase or UI elements.

By uploading content (Resumes, Job Descriptions, Logos), you grant Nishulk4U a worldwide, completely royalty-free license to host, display, and distribute said content solely for the purpose of facilitating the recruitment process.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. NISHULK4U DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Nishulk4U and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your access to or use of the platform. This includes damage resulting from lost data, missed employment opportunities, or fraudulent employer profiles.

9. Indemnification

You agree to indemnify and hold harmless Nishulk4U, its directors, and employees from any claims, damages, liabilities, and expenses arising from your violation of these Terms or your infringement of any third-party rights, including intellectual property and privacy rights.

10. Governing Law & Dispute Resolution

These Terms shall be governed strictly by the laws of India. Any disputes or claims arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana. Users agree to attempt amicable arbitration before executing any formal legal proceeding against Nishulk4U.

11. Modification to Terms

Nishulk4U reserves the unilateral right to update, modify, or replace these terms at any time. Material changes will be communicated via email or a prominent platform notification. Continued use of the platform after modifications constitutes acceptance of the new Terms.
